Terms of Service - Easy Internet Group of Companies

Easy Internet Group of Companies holds a right to change terms of service at any time, changes will be affective immediately. Easy Internet Group of Companies will inform a customer when terms of service have been changed.

1.CONTRACT PARTIES

This contract will be made with Easy Internet Group of Companies (later HostWebNine) ja web hosting, reseller, or virtual server customer (later Customer). These terms are legal as soon as order of a service has been made.


2.OBJECT OF A CONTRACT

Contracts object is HostWebNines service for customer. Customer will promise to obey terms of service and use ordered service as described below.


3.HOSTWEBNINES RESPONSIBILITY

HostWebNine will provide all possible information needed to use the service ordered by a customer. HostWebNine will give usernames and passwords only for contacts given by a customer. HostWebNine is not responsible for customers web hosting, reseller, or virtual server data or functionality. HostWebNine is not responsible from network or possible any other attacks towards clients service. HostWebNine is not responsible for harms caused by viruses. HostWebNine is not responsible for problems caused by third party user or company. HostWebNine can provide the ordered service in a way that is best for them. HostWebNine has a right to change service or its attributes without any information if that is necessary because of security, technical or other reasons. All possible changes will be notified as soon as possible. HostWebNine has a right to block all usage that brakes terms of service.


4.CUSTOMERS RESPONSIBILITY

Customer is responsible for storing username and password in a secure place and for any activity done by using that information. Customer is using network and ordered service with own responsibility. When registering a domain name, customer is responsible for obeying all ICANN rules. Customer is responsible for the domain name and its usage. When customers and HostWebNines contract ends, customer is responsible to register, transfer and renew the domain name. Customer is responsible for all data stored in the ordered service and obey all Finnish laws and goodwill. All material uploaded to the web site have to be legal, it can not be racists and it can not break any laws or cause harm to other people. Customer is responsible for preventing all possible harms to the network in use. HostWebNine can and will remove all illegal data or data that is not suitable for viewers. Customer will store all data to the server with own responsibility. Customer can use ordered service and disk space only for own, company or community use. Diska space can not be resold, this doesn't include banner all other commercial adds on the web page. All public viewable material must be legal and not harmful in any way. Disk space is limited to the amount that has been told when ordering the service. Customer is responsible to compensate and to all third parties all possible costs that has been caused by service abuse. HostWebNines or other third party services unauthorized access is strictly forbidden. Customer can not try to search any possible security flaws or test the servers intrusion mechanism, this will cause immediate service termination and legal suit. Customer can not use the service for spamming, or any kind of advertising that is not legal or brakes the goodwill. Customer can not advertise the web site via email, news groups, bulletin boards or any other places where it is forbidden. Customer is responsible storing own backups of website used in HostWebNines service. HostWebNine can not and will not guarantee storage safety and can not prevent data loss incase of hardware failure. If service usage, bandwidth or server resource usage, will not stay within the normal limits, HostWebNine can limit or increase the pricing of the ordered service. All possible changes to service and its attributes will be done by negotiating with the client.


5.PAYMENT

Customer relationship and billing of web hosting, reseller, or virtual server starts immediately when order is received by HostWebNine. Customer will pay web hosting, reseller, or virtual server service fee according to the pricelist that is up to date. HostWebNine will post up to date pricelist and terms of service on the web site hostwebnine.com. Customer will choose a billing period when ordering. Billing will be done advanced before new billing period starts. If customer will not pay the invoice, HostWebNine can and will suspend the ordered service. If customer will not pay the invoice after payment notifications, HostWebNine will not renew a domain name and will terminate the ordered service and remove all data from storage and from backups. HostWebNine can charge a fee when unsuspending the ordered service. All domains belong to HostWebNine until customer has paid the invoice compeletely. Invoise has to be paid on the due date at the latest. HostWebNine will charge 5,00 euros for every sent payment notification. HostWebNine can transfer all unpaid invoices to a third party collecting agency. HostWebNine has a right to change services and prices at any time. Changed prices are effective immediately and will be used on customers next invoice. Customer will be informed about all price changes before new billing period starts.


6.VALIDITY

Contract starts immediately when HostWebNine receives the order. All contracts are valid for the billing period chosen by the customer. If customer will not terminate the contract, the contract will renew again and is valid for the billing period chosen by the customer. Contract termination has to be done 1 month before the beginning of a new billing period. HostWebNine can and will terminate the contract if customer has not paid an invoice inside 28 days starting from the original due date. Customer can not get any compensation if contract is terminated because of non-payment.


7.TECHNICAL LIMITATIONS

Customer have HostWebNines web hosting, reseller, or virtual server service. Web hosting, reseller, or virtual server services attributes  are told on service agreement and at the order page. Every service have their own different attributes and limitations (disk space, bandwidth etc) are told at the order page. HostWebNine can and will charge an extra fee if customers disk space has been overused. HostWebNine will deliver the ordered service as soon as possible after the payment has been received. Some parts of the order (example domain registrations or transfer), can be delayed because of third party service providers included. HostWebNine will inform a client for any possible delayes and resons.


8.SERVICE FAULTS, REPAIRS AND POSSIBLE COMPENSATIONS

Service has a fault if it differs essentially from the ordered service or the service does not function. Customer is responsible for notifying HostWebNines support for any faults that might occur. All services are automatically monitored and all possible faults will be fixed as soon as possible. HostWebNine trys to minimize all faults and to notify customers in customer zone. HostWebNine reserves a right not to fix anything if it has been caused by customer, or it is caused by abuse, or misusage of the service. HostWebNine is not responsible for any faults regarding to third party networks, softwares or any other faults. HostWebNine is not responsible for any faults related to force majeure or third party actions. All reclaims related to faults must be sent in 7 days. HostWebNines is responsible to compensate all faults caused by HostWebNine itself. HostWebNine is responsible to compensate maximum of two months service fee. HostWebNine is not responsible to compensate faults caused by third parties or indirect accidents.


9.CONTRACT TRANSFER

Customer can not transfer any contracts to a third party customer without HostWebNines permission. HostWebNine can transfer all contracts to a third party company by notfying the client.


10.OTHER OPTIONS

Contract has been made between HostWebNine and a customer. Customer is responsible to keep all terms of service, prices, other agreements and messages from HostWebNine as classified. Customer is responsible for all his/her employees will follow these terms of service.


11.DISAGREEMENTS

All diputes or disagreements will be handled in HostWebNines domicile in Sheffield.


12.CONTRACT CHANGES

HostWebNine reserves a right to change prices and terms of service.



12.UNLIMITED WEB HOSTING

The use of the any unlimited disk space or bandwdith package is subject to the following terms

1.All accounts must have valid, working websites, and not violate any previously subscribed terms
2.Hosting service usage have to be so called normal web hosting usage
3.Accounts are not for use of mass storage of backups, files, audio, video, zip files, or similar
4.Accounts are not for the use of mass distributing of files such as torrents or mirrors
5.Any accounts found to violate these terms may be suspended without notice until the account holder agrees to resolve the issue

All above mentioned limitations are suggestives. HostWebNine will not interfere the hosting services functionality unless the usage is abnormal or we are suspecting some kind of intentional overloading of the hosting server.

Server Limits
30% cpu and or memory for 3 minutes.
Combined 8% CPU & RAM over 24 hours.
1000 email limit per hosting service per one hour.
50 concurrent database connections at one time.
Apache threads to be open no longer then 999 seconds.
Php upload limit of 15MB.
Max php session time of 300 seconds or less.
Limits are subject to change at anytime.
